Our Law Firm is NOT a Personal Injury Settlement Mill

All of us are flooded with television ads for personal injury lawyers in South Carolina. In one ad, a runner for the law firm was engaged in parkour (doing flips, jumping over benches and obstacles, etc.) as he delivered checks for large sums of money to very happy and upbeat “victims” of catastrophic injuries. In another ad, smiling and seemingly uninjured clients gave brief “testimonials” about how easy it was for them to get hundreds of thousands of dollars for their injuries. Then in another ad, a lawyer pulled oversized hundred-dollar bills out of the front-end of a wrecked vehicle and told folks that if they call the firm, they’ll get huge bucks too. In these ads, it seems that all they are doing is writing huge checks for their clients each day because the insurance companies cower at the mention of their names.

Personal Injury Settlement Mills – Quantity Over Quality?

A personal injury mill is a law firm that advertises A LOT for personal injury cases and handles an exceptionally high volume of claims. If a law firm emphasizes the number of cases instead of the quality of results, then they could cause insurance companies to low-ball settlement offers for every potential personal injury claimant. In other words, a personal injury settlement mill may grind down the meaning of real justice for many personal injury victims. Once, during a settlement discussion Stephan Futeral had with an insurance adjuster, the adjuster offered our client an amount that seemed too little to compensation our client for their injuries. During the discussion, the adjuster actually said, “I just settled a claim just like this one with [an advertising personal injury firm] for this amount, so what makes you think your client deserves more?” Stephan responded by saying, “Because that’s not good enough for my client.”

Remember that what you see on television is advertising. When you hire a personal injury lawyer in Charleston, South Carolina, you don’t just get a check by making a phone call or find that justice somehow comes in the form of large bills rolling out of the front-end of a wrecked sedan. In all the years that we have handled personal injury claims in Charleston, our clients don’t act like grinning fools when they receive a settlement or verdict. For most clients, settlements or awards by juries are bitter-sweet. Although they are thankful for the work we’ve done, they’d rather live pain and disability-free, or share the life of the family member they lost due to negligence, than mug for a camera over the settlement check they received from their lawyer.

Questions You Should Ask a Personal Injury Attorney

Any personal injury lawyer in Charleston or elsewhere in South Carolina is ethically prohibited from taking on more work than they can handle. So how many is too many? That depends on the lawyer’s abilities, how simple or complex their cases are, whether they have sufficient support staff and the clients’ needs. Having said that, when a lawyer is handling hundreds of cases simultaneously, it becomes challenging to give each client the quality of attention each one of them deserves. So here are some questions you need answers to before you decide which personal injury lawyer to hire:

1) How many cases are you (the lawyer) handling? This is a fair question, If the lawyer won’t answer or hedges around the answer, move on to your next choice of lawyers.

2) How many lawsuits has the lawyer filed in the last 12 months? Not all cases settle, and that’s certainly true of personal injury claims. If their answer is “none” or just a few, then ask the next question:

3) How many personal injury cases have you tried in your career? At the end of the day, you need a personal injury lawyer who knows how to take a case to trial if the case doesn’t settle.

4) Who will be working on my case? You need to know whether the personal injury attorney you are dealing with is going to handle the case one-on-one or pass you off to someone else in the firm such as a paralegal.

5) If my case doesn’t settle, will you file a lawsuit? The answer should be “Yes.” You want a lawyer who is going to see your case through from start to finish.

Personal Injury FAQ’s

How long do I have to file a personal injury lawsuit in Charleston SC?

You generally have 3 years from the date of injury to file a personal injury lawsuit in Charleston SC (S.C. Code § 15-3-530). Claims against a city, county, or state agency under the SC Tort Claims Act must be filed within 2 years. Miss the deadline and your claim is barred forever — no matter how strong it is. Evidence also disappears quickly, so contact a lawyer well before the deadline.

What should I do after a car accident in Charleston?

Call 911 and get medical attention first — then document everything. Photograph the vehicles, scene, and your injuries; get the other driver’s insurance and contact information and any witness names; and report the crash to your own insurer. Do not give a recorded statement to the other driver’s insurance company, and do not sign anything before speaking with a Charleston car accident lawyer.

How much does a personal injury lawyer cost in Charleston?

Nothing upfront — we handle personal injury claims on a contingency fee, meaning you pay no legal fees unless we recover money for you. In many cases, the fee is one-third of the total recovery. Your consultation is free, so there is no financial risk in having a lawyer evaluate your claim before you talk to any insurance adjuster.

How much is my personal injury case worth?

There is no formula for case value in Charleston SC. The value depends on the severity of your injuries, your medical bills (past and future), lost wages and earning capacity, pain and suffering, and the available insurance coverage. Beware of any lawyer or ad that promises a number before reviewing your medical records — every legitimate valuation starts with the evidence.

Is Charleston SC an at-fault state for car accidents?

Yes — Charleston SC is an at-fault state, meaning the driver who caused the crash (through their insurer) pays for the resulting injuries and property damage. Drivers must carry minimum liability coverage of $25,000 per person and $50,000 per accident for bodily injury, plus $25,000 for property damage, along with matching uninsured motorist coverage.

What if I were partly at fault for my accident?

You can still recover damages in Charleston SC as long as you were 50% or less at fault — your compensation is simply reduced by your percentage of fault. This is called modified comparative negligence. If you’re found 51% or more at fault, you recover nothing. Insurance adjusters know this rule and often try to inflate your share of blame, which is why fault disputes deserve a lawyer.

What happens if I'm hit by an uninsured driver in Charleston SC?

Your own uninsured motorist (UM) coverage pays for your injuries, and every Charleston SC auto policy must include it at minimum 25/50 limits. Underinsured motorist (UIM) coverage, which is optional, applies when the at-fault driver’s insurance isn’t enough to cover your damages. Claims against your own insurer are still adversarial; they can and do dispute value.

Should I talk to the other driver's insurance company?

No — never give the other driver’s insurance company a recorded statement without talking to a lawyer first. Adjusters are trained to ask questions that minimize their payout: getting you to downplay injuries, admit partial fault, or commit to facts before you know the full extent of your damages. Refer them to your attorney and let your lawyer handle all communication.

Should I sign a release or accept the insurance company's first offer?

No — once you sign a release, you cannot recover anything more, even if your injuries turn out to be worse than you thought. First offers typically come before the full extent of your medical treatment is known, and almost never account for future care or lost earning capacity. Have a personal injury attorney review any release or settlement offer before you sign.

How long does a personal injury claim take in Charleston SC?

Straightforward claims often settle within a few months after medical treatment ends; contested cases that go to litigation typically take one to two years or more. The timeline depends on the length of your medical recovery, the clarity of fault, and whether the insurer negotiates fairly. A quality settlement usually takes longer than a quick lowball one — and the difference can be substantial.

Will my personal injury case go to trial?

Most personal injury cases settle without trial — but the credible threat of trial is what drives fair settlements. Insurance companies track which lawyers actually try cases and which always settle. Our Charleston injury lawyers prepare every case as if it will be tried in the Charleston County Courthouse, which is exactly why most of them never need to be.

Are there caps on personal injury damages in Charleston SC?

There are no caps on compensatory damages in most Charleston SC personal injury cases — your medical bills, lost wages, and pain and suffering are not limited. Exceptions exist: noneconomic damages in medical malpractice cases are capped by statute (S.C. Code § 15-32-220, adjusted annually for inflation), punitive damages are generally capped at three times compensatory damages or $500,000 (§ 15-32-530), and claims against government entities are capped under the Tort Claims Act.

Who can file a wrongful death claim in Charleston SC?

A wrongful death claim in Charleston SC is filed by the executor or administrator of the deceased person’s estate, for the benefit of the surviving spouse and children — or parents and heirs if there is no spouse or child (S.C. Code § 15-51-20). Damages can include funeral expenses, lost financial support, and the family’s grief and loss of companionship. The statute of limitations is generally 3 years from the date of death.

What is Charleston SC's dog bite law?

Charleston SC is a strict liability state for dog bites — under S.C. Code § 47-3-110, the owner is liable if the dog bites or attacks you while you’re in a public place or lawfully on private property, even if the dog never showed aggression before. You don’t have to prove the owner was negligent. Provoking the dog is the main defense, and homeowner’s insurance typically pays these claims.

Can I recover compensation for a slip and fall in Charleston SC?

Yes — if the property owner knew or should have known about the dangerous condition that caused your fall and failed to fix or warn about it. Slip and fall claims in Charleston SC turn on notice: how long the hazard existed, whether staff created it, and whether warnings were posted. Photograph the hazard immediately and report the fall before leaving — those two steps often decide these cases.

Did Charleston SC's 2025 tort reform law change injury claims?

Yes — Charleston, SC’s 2025 tort reform act (S.244) changed how fault is divided in injury lawsuits. Juries now allocate percentages of fault among all parties, and a defendant found less than 50% at fault generally pays only its percentage of the damages rather than the full amount. The law also revised alcohol-related liability rules for bars and restaurants. These changes make experienced trial counsel more important, not less, in multi-defendant cases.
